The problem of the study lies in the importance of determining the types of judicial punishments, since the judicial punishments in health laws differ according to the act or violation that is being committed. The main question of the study was what are the judicial punishments (criminal, civil and administrative) in the Saudi health laws? What are its judicial applications?
The study aimed to clarify what is meant by the theory of worldly punishment, and then to explain the judicial punishments of all kinds resulting from the violation of the Saudi health laws, with the most prominent judicial applications of the judicial punishments of all kinds in the Saudi health laws.
The research approach used is summarized in the descriptive approach based on analysis and conclusion, and then comparison and application, by tracking the issues under study and presenting them in Islamic jurisprudence and the Saudi health system to reach solutions to the research problem and its questions.
The most important results of the study: that the punishment theory can be applied to any law based on the protection of people's rights through their actions, and it turns out that the medical offense is the presence of the charge, and the medical errors is the presence of negligence, and administrative violations is the violation of professional ethics. Determining the responsibilities and ensuring the doctor in Islamic jurisprudence is consistent with what was stated in the health laws. The organizer's concern for the substantive and procedural judicial punishments in the health laws in the Kingdom.
The most important recommendations of the study were: the establishment of specialized medical courts, and the increase of awareness of the health practitioner in his dealings with the patient by the Ministry of Health, and the publication of judicial rulings and previous decisions issued by criminal courts and quasi-judicial committees of the Ministry of Health. Considering the development and modernization of some health laws.
