Abstract
:
The absence of plaintiffs is a hindrance to judicial action, and in the event of non-attendance of litigants and in order to expedite the procedures, the Saudi lawmaker has allowed the court to rule in absentia in order to achieve justice. And since this absence may be influential in the course of justice according to its various forms, the lawmaker has authorized ways to object to absentee rulings which may change the judgment imposed, to enable Rights Holders to access to their rights. The importance of this study is that it achieves an important aspect of the delivery of rights to its owners by knowing the rights of those sentenced in absentia and determining the cases that they are entitled to object to by opposition and the consequential regulatory effects. This is reflected in protecting the rights from being lost and to give those sentenced in absentia the opportunity to catch up with such rights, which ultimately leads to justice and the interests of society.
