Abstract
:
Thesis Subject: studying the jurisprudential annotations of the message on judicature, and the statement of the most important features of each annotation, in terms of method of inference, and the use of jurisprudential and fundamentalism rules -if any- and the method of deduction, and so on, through the extrapolation and study of these annotations. In my study of the annotations, I only studied and analyzed the traditional jurisprudential annotations. I divided the annotations into two chapters: the first chapter is about the annotations that encompassed the whole message, where I arranged them according to the authors’ dates of death; the second chapter is about the annotations that explained parts of the message, where I also arranged them by the authors’ dates of death. In my study, I concluded that: Omar bin al-Khattab message on judicature is one of the most important and greatest historical documents written in the science of judicature in the history of Islam; scholars and imams always received this message with acceptance and paid great attention to it in terms of study and explanation. I advise the esteemed judges to pay attention to this message. I also advise the editors to take the initiative to print the book of Imam Cosnatine "CONQUEST OF THE GENEROUS KING," and to publish this book, because it is an important reference in this science.
