Abstract : The jurisprudential provisions concerning the worship in night, and in the books of purity and prayer in particular, are among the most important and most useful subjects because they are related to the most important task that Allah has entrusted us with, namely prayer. I did not find - according to my knowledge – in purity and prayer books contain the provisions relating to the night, except what is mentioned in the jurisprudence books, brief and detailed versions. Hence, it is clear that the study of the jurisprudential provisions (concerning the night within the purity and prayer is a comparative jurisprudence) is one of the important topics, of great interest; because they are associated with many worships. In my opinion, the collection of issues of jurisprudence related to the night is in one position, and it’s a comparative jurisprudence study. The methodology used in the research has made the research a comparative study between the four doctrines. The research starts with mentioning the four doctrines using the chronological order; beginning with Al-Hanafiyyah and the one who agreed with them, then the Al-Malikiyyah and those who agreed with them, then the Shaafiyiah and those who agreed with them, then Al-Hanabelah. The research consists of an introduction, a preface, two chapters, a conclusion, and a list of sources and references. The introduction mentioned the importance of the topic, the reason for its selection, the previous studies, the research plan and the methodology used. As for the preface: in the definition of the night and subjects related to it, and it contains two sections: the first section: definition of the night and its synonyms, the second section: night levels of the linguists and scholars, and how to estimate the night in the countries where the day extends for several days. For the chapters, it contains two: The first chapter: the jurisprudential provisions related to the night in the book of purity, and it has three sections. First section: The jurisprudential provisions concerning the night in the subject of water and ablution, second chapter: the jurisprudential provisions concerning the night in the subject of Sewak, third section: the jurisprudential provisions concerning the night in the section of washing. The second chapter carries the title of jurisprudential provisions concerning the night in the subject of prayer and it contains ten sections: 1st section: jurisprudential provisions concerning the night in the subject of prayer, 2nd section: jurisprudential provisions concerning the night in the subject of Al-Athan, 3rd section: jurisprudential provisions concerning the night in the subject of prayer of the people of excuses, 4th section: jurisprudential provisions concerning the night in the subject of fixed Sunnah at night, 5th section: jurisprudential provisions concerning the night in the subject of night Nawafil, 6th section: jurisprudential provisions concerning the night in the subject of Witr, 7th section: jurisprudential provisions concerning the night in the subject of worship in Witr prayer at night, 8th section: jurisprudential provisions concerning the night in the subject of Tarawih prayer, 9th section: jurisprudential provisions concerning the night in the subject of eclipse prayer, 10th section: jurisprudential provisions concerning the night in the subject of re-prayer. Then, the conclusion, and list of sources and references. The aim of the research is to collect the issues that are related to the time of night in one book, and this is what I sought to reach. It also aims to facilitate access to any rule or issue related to the night to those who intend to do so. This research concluded that there are certain provisions concerning the time of night, and if the time changes and becomes a day, the judgment varies according to time, for example, the rule of re-praying the Witr if it was missed at night, and other provisions. At the conclusion of the research, the recommendation to complete the remaining provisions related to the night in the rest of the books of other jurisprudence.
